What happens if the Environmental Protection Bureau catches someone violating spray-painting regulations?
According to the severity of the offense, fines will be imposed, and the site must be restored to its original condition within a specified timeframe. Article 108 of the "People's Republic of China Air Pollution Prevention and Control Law" states: Any entity that violates the provisions of this law by engaging in one of the following activities shall be ordered by the environmental protection authorities at or above the county level to make corrections and pay a fine ranging from RMB 20,000 to RMB 200,000. If the entity refuses to comply, it may be ordered to suspend production for rectification. (1) Production and service activities generating volatile organic compound (VOC)-containing waste gases are conducted outside enclosed spaces or equipment, failing to install, operate pollution control facilities as required, or implement measures to minimize emissions. (2) Industrial coating enterprises fail to use low-VOC coatings or fail to establish and maintain proper records. (3) Enterprises involved in petroleum, chemical, and other industries that produce or use organic solvents neglect to perform routine maintenance and repairs on pipelines and equipment, leading to material leaks—or fail to promptly collect and treat leaked materials. (4) Oil and gas storage facilities, fueling stations, and vehicles such as oil tankers and gas tankers do not install and properly operate vapor recovery systems in accordance with national regulations. (5) Enterprises in sectors like steel, building materials, non-ferrous metals, petroleum, chemicals, pharmaceuticals, and mining fail to adopt measures such as centralized collection and treatment, enclosure, containment barriers, covering, regular cleaning, and water spraying to effectively control and reduce emissions of dust and gaseous pollutants. (6) Combustible gases generated during industrial production, landfill operations, or other activities are either not recovered and utilized; when recovery is not feasible, they are left untreated to prevent pollution; or, if the gas recovery and utilization systems are malfunctioning, timely repairs or upgrades are not carried out. **Additional Information:** **Case Study: A Company in Qingbaijiang District Fined RMB 20,000 for Conducting Paint Spraying in an Open Space** Law enforcement officers discovered that the company was conducting paint-spraying operations inside a bathroom cabinet production facility, despite the spray booth door remaining open. This resulted in the release of VOC-containing waste gases into the atmosphere. The company specializes in manufacturing and selling bathroom cabinets, and its environmental protection filing clearly stipulates that all painting activities must take place in a sealed spray booth. The emitted VOC gases are then treated through a series of advanced purification systems, including a water curtain, exhaust ventilation, activated carbon adsorption, and photocatalytic oxidation units, before being discharged via a 15-meter-high chimney. Enforcement officials explained that this behavior violated Article 45 of the "People's Republic of China Air Pollution Prevention and Control Law." Immediately after identifying the violation, Qingbaijiang District Environmental Protection Bureau officers issued a "Decision on Ordering Correction of Illegal Behavior," while also providing on-site education to the company’s management team about relevant environmental protection laws and regulations. A few days later, enforcement officers returned to Chengdu Taoyiju Bathroom Co., Ltd. for a follow-up inspection. They confirmed that the company was actively producing, with the spray booth already closed and operational. Additionally, an air intake vent had been installed on the roof of the booth to ensure proper sealing during operation. "The company has now completed all necessary corrective actions related to the violation," stated officials from the Qingbaijiang District Environmental Protection Bureau. Under the relevant regulations, any production or service activity generating VOC-containing waste gases but failing to conduct operations in enclosed spaces or equipment—and thus failing to install or use appropriate pollution control facilities, or to implement measures aimed at reducing emissions—will face penalties. Specifically, the company was fined RMB 20,000 for its violation.
